Terms of Service

These Terms of Service ("Terms") govern your access to and use of Luminabook (the "Service"), operated by Alexandre Silva Alves, an individual sole proprietor trading as Lumina Book ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. Who you are contracting with

The Service is provided by Alexandre Silva Alves, trading as Lumina Book. If you have questions about these Terms you can contact us through the support channel inside your account.

2. Eligibility & account

You must be at least 18 years old (or the age of majority in your jurisdiction) and, if signing up on behalf of a business, authorised to bind that business. You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it updated.

3. The Service

Luminabook provides scheduling tools, a public booking page, staff calendars, client records, deposit collection and related analytics for service businesses. Features may evolve over time. We do not guarantee that the Service will be uninterrupted, error-free or continuously available.

4. Acceptable use

You agree not to:

  • use the Service for anything unlawful, fraudulent, deceptive or harmful;
  • send spam, phishing or unsolicited communications through the Service;
  • infringe intellectual property or privacy rights of others;
  • upload malware or interfere with the security or integrity of the Service (probing, scraping, reverse engineering, or circumventing technical limits);
  • resell or redistribute the Service without our written consent.

5. Your content and clients

You retain ownership of the data you upload (business details, services, staff, customer records). You grant us a limited licence to host, process and display that content solely to provide the Service. You are responsible for having a lawful basis to collect and share your customers' personal data with us and for honouring their rights.

6. Intellectual property

The Service, including software, design, branding and documentation, is owned by Alexandre Silva Alves (Lumina Book) and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with your plan and these Terms.

7. Fees, subscriptions and payments

Paid plans are billed on a recurring basis at the price shown at checkout. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Our refund policy is described in our Refund Policy.

8. Free trial

New accounts include a 7-day free trial. You will not be charged during the trial. If you do not subscribe to a paid plan before the trial ends, your access to paid features is paused until you subscribe.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time from your billing settings; access continues until the end of the current billing period.

10. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties. Our aggregate liability arising out of or related to the Service is capped at the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special or exemplary damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Indemnity

You will indemnify us against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated in-app or by email. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of the seller's domicile, unless otherwise required by consumer protection law.
